We had the same type of situation with an after-school video club that was
sponsored by a teacher. The students and a teacher met after school
(around 6:00 p.m.) to watch "newly released" videos / DVDs of "outstanding"
movies and then critique them. Although it appeared harmless in nature and
the teacher kept explaining to the administration that this WAS a teaching
situation, a few of us (multimedia teacher and librarians) finally convinced
the administration that we needed to purchase a movie license in order to
allow this teacher to continue using videos / DVDs with students after
school because it did NOT fall under "fair use guidelines"---it was not a
regularly scheduled class set within the school's curriculum (it was an
after school program) and because it was not a "class" (anyone could join
throughout the year)--- it was a public performance.
We now have a motion picture license which is a big break-through for us
(and now our teachers are actually becoming more aware of what they can and
cannot do with videos--and other issues materials relating to copyright!)
