This has caused some confusion, so let me clarify my original statement.
My understanding of video taping and copyright comes from my
experience as a drama teacher. In that case, we were taught that a
single videotaping of a production was allowable, unless specifically
forbidden in the contract, provided the tape was only used as an
archival record of the production. A live theatrical production has
many elements unique to it because of choices made by the director,
costume designer, actors etc., So that's what I meant by the term
archival copy.Perhaps I was incorrect in using it to refer to a music
concert...
In addition, my understanding of fair use indicates that same
archival tape can be used in face to face instruction to allow
students to critique their performance. That tape being distributed
to parents and students would be against copyright because the
specific clauses of the performance contract for dramatic productions
(unless we're taking something in the public domain) spells out that
video reproductions are not allowed.
My confusion comes from knowing that there is not generally a
contract signed for band performance rights (unless it's competitive
marching band or something) so I wasn't sure what the law said about
that.
