The IEP says the school is legally required to acquire certain things =AF =
but they do have to acquire them in legal ways. THey can't steal them any =
more than they could steal an Alphasmart if the IEP said the child needed =
one. =20
Same rationalization as "it's for education, so it's okay." =20

Tawana West asked:
OK, now...do any of you know
if there is an exemption from copyright laws for special education, and/or
is it true that "equal
access" to education supersedes other laws?
I, too, would be interested in the answer. I had a special ed teacher =
copy
almost all the books-on-tape in the library. She kept the tapes in her
classroom. She insisted that it was legal because the student was =
required
to have books-on-tape per her modifications. I never felt that one could
overrule a law in that way. The worst part was that whenever a teacher
needed a certain book-on-tape and it was not available, the teacher would
say, "Never mind. I can get one from Mrs. so-and-so. She has all of them
in her classroom!"
